Under the agreement, BioMarin will waive certain regulatory rights and exclusivities, drop all proceedings against Ascendis, and provide a covenant not to sue over the disputed intellectual property. In return, Ascendis will pay BioMarin royalties on navepegritide-related net sales – 20 percent in the US and 18 percent in the EU, South Korea and Brazil – running from each country’s first commercial sale through May 20, 2030.

YUVIWEL is Ascendis’s treatment for achondroplasia and other skeletal dysplasias, built on its TransCon prodrug platform. The settlement removes a legal overhang just as the drug’s US uptake is accelerating.
