Klaria receives notification of patent approval in the EU
Klaria has received notification of patent approval from the European Patent Office regarding the second patent in the patent portfolio for Sumatriptan Alginate Film (SAF).
The notification indicates that the new patent, and all associated patent claims, will be granted in their entirety.
SAF is already protected by granted patents in key markets such as the EU and the US, and the granting of the second patent extends this protection. Patent protection for a marketed product rarely relies on a single patent. Extending protection through additional patents provides Klaria with greater manufacturing flexibility, but above all, it enables the company to identify and take action against patent infringement and acts as a deterrent against the development of similar, competing products without Klaria’s consent.
Earlier this year, Klaria announced that a positive opinion had been received regarding both novelty and inventive step—the fundamental requirements for a valid patent—for the third patent in the SAF patent family. The purpose of the third patent is to protect the specific characteristics of the marketed product and to extend patent protection, and thereby market exclusivity, until 2045.
